2. Service Usage & Acceptable Use
You may not use the Services for any unlawful, harmful, or abusive activity, or to facilitate such activity. We may suspend or terminate Services immediately if we reasonably believe your use presents a risk to our network, other customers, third parties, or compliance obligations.
Prohibited activities: include (but are not limited to): malware distribution, phishing, spamming, fraud, credential theft, botnets, unauthorized access attempts, scanning/exploitation, or facilitating DDoS attacks.
Network abuse: traffic flooding, reflection/amplification attacks, or any activity that disrupts the Services or impacts other customers is prohibited.
Content restrictions: illegal content (including child sexual abuse material and non-consensual sexual content) is strictly prohibited and may result in immediate termination and reporting where required by law.
Copyright: you are responsible for ensuring you have rights to host and distribute any content. We may act on copyright complaints and remove or disable access where appropriate.
3. Email & Spam
Sending spam, bulk unsolicited email, or operating open relays is prohibited. If abuse is detected, your service may be suspended immediately. You are responsible for securing scripts, CMS installs, and credentials that could be used to send spam.
We may apply outbound mail limitations to protect the network and our IP reputation.
4. Managed & Customer Responsibilities
Unless explicitly stated as “managed,” Services are provided on an unmanaged basis. We ensure the underlying service is provisioned and functioning as advertised, and we will address issues within our infrastructure. You are responsible for server administration, configuration, application setup, code, security hardening, and updates.
5. Account Balance & Refunds
HostViber Ltd primarily issues refunds in the form of HostViber Ltd account balance. Account balance may be used toward future services and is non-transferable.
A monetary refund (original payment method) will generally only be considered where a client has reported a problem that falls within the scope of the service provided by HostViber Ltd, and where we are unable to resolve the issue within a reasonable timeframe.
1. Refund requests must be submitted through our official support channels and must include sufficient detail for investigation.
2. Issues caused by client configuration, third-party software, misuse, or violations of these Terms are not eligible for monetary refunds.
3. Services suspended or terminated due to abuse, spamming, fraud, chargebacks, or ToS violations are not eligible for refunds of any kind.
4. Setup fees, one-time charges, and services already rendered may be non-refundable.
HostViber Ltd reserves the right to determine refund eligibility on a case-by-case basis in accordance with these Terms and applicable law.
6. Billing, Invoices & Payments
Invoices must be paid on or before the due date. We may suspend services for non-payment. A short grace period may be provided at our discretion; after suspension, data may be subject to deletion after a reasonable period.
We do not store full payment card details. Payments are processed by third-party providers. If you enable recurring payments (e.g., PayPal subscription), you are responsible for canceling the subscription with the provider when you wish to stop recurring charges.
7. Backup & Data Integrity
You are responsible for maintaining backups of your data. Unless a backup service is explicitly included in your plan, we do not guarantee that backups exist or can be restored. We are not liable for data loss, corruption, or service interruption.
After termination or prolonged non-payment, we may delete data from our systems in accordance with operational needs and legal requirements.
8. Account Security
You are responsible for all activity conducted through your account, including safeguarding passwords, API keys, and access tokens. If you suspect compromise, notify us promptly and rotate credentials. You must maintain reasonable security practices and keep software updated.
9. Fair Usage Policy
We apply fair usage limits to protect service quality for all customers. While plans may advertise generous allocations, usage must remain consistent with the intended purpose of the service tier.
Fair usage may consider CPU/RAM, disk IO, bandwidth patterns, and storage usage relative to your plan.
Where exceeded, we may contact you to reduce usage, upgrade, or apply limits to maintain stability.
10. Refusal & Service Termination
We may refuse service, suspend, or terminate accounts where we reasonably suspect fraud, abuse, ToS violations, legal risk, or conduct that threatens staff, customers, or infrastructure. Where feasible, we may provide notice and an opportunity to remedy, but immediate action may be necessary in urgent cases.
11. Data Protection
HostViber Ltd processes personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR). Details regarding how we collect, use, and protect personal data are set out in our Privacy Policy
Depending on the nature of the Services, HostViber Ltd may act as a data controller or data processor. Clients remain responsible for ensuring their own compliance with data protection obligations in relation to data they process using the Services.
12. Disclaimer & Warranties
The Services are provided on an “as is” and “as available” basis. HostViber Ltd makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such disclaimers are not permitted under applicable law.
